The Subdivision Ruling has caused a lot of discord and the decision on the ruling is referenced as to prevent locals from “fraudulent developers” such as the Village of Penland.
So how many lots did Vlilage of Penland have?
More than 5??
Thought so.
Why is the subdivision ordinance effective at 5 lots when we all know “these evil developers” won’t waste their time with only 5 lots?
5 lots in a Hollar could be a family and throughout the course of time each family member sells their “lot” then buyer number 5 is hit with all the ordinances.
You may say that’s not true.
Well we know for decades that the laws are interpreted based upon who’s reading it. This law is written poorly and will only hurt Mitchell County.
