Mitchell Commissioners Address New Ordinances

Mitchell County commissioners held two public hearings during their regular scheduled meeting on Monday evening July 10th.

The first one concerned the Chemical Spills Ordinance. There were three significant chemical spills last year in Mitchell County. The ordinance is aimed at large chemical spills that require shutting down roads and significant clean up. It also addresses reimbursement for first responders for response and cleanup costs.

One person addressed commissioners with concerns about not being notified when there are spills in an area and when chemicals go into ponds and rivers. Another person addressed the seriousness of chloride spills and also concerns about chemical trucks on the small narrow roads in the Red Hill section.  Another addressed concerns that the ordinance affected car owners who would be responsible for cleanup costs even if the accident was not their fault. It was suggested the ordinance only apply to commercial vehicles.

The second public hearing was on the revised proposed Subdivision Ordinance. County Manager Allen Cook explained several revisions to the original ordinance including the proposal that the ordinance not apply to any land under 3 acres if no street or right of way is involved. Also changes were made to allow families to divide land without having to meet ordinance standards.

Subdivision easement and access roads must be able to accommodate fire vehicles. Several people agreed with dropping requirements from 10 to 3 acres but suggested that Spruce Pine and Bakersville be exempt to allow for urban development.

There was also concern from someone who had tried for several years to get land surveyed. It was suggested that if they move forward with the new requirements they need to be sure that they have the manpower available so people can meet the requirements.

Cook said he appreciated the citizens input. That the ordinances are set up for fire protection and emergency situations, to protect developers, protect citizens from scams and help with infrastructure development.
