A special meeting was held on Monday, August 28th at the Yancey County Board of Elections to announce the decision as to one candidate’s eligibility for the upcoming Burnsville town elections. There are two seats available for the Town Council and three people had filed for those positions. Incumbents Judy Buchanan and Denise Collier have both filed along with newcomer John Nicholson Jr. Questions had arisen as to the location of Nicholson’s fulltime residence and an official candidate challenge was filed on July 24th. Candidates are required to live within the Burnsville town limits. A hearing was held on August 10th to determine Nicholson’s eligibility. At the meeting on Monday, August 28th, Burnsville Town Attorney Donny Laws informed Nicholson that he did not meet the residency requirement. With Nicholson disqualified that would leave incumbents Buchanan and Collier as the only two candidates on the ballot. According to Chairman of the Yancey County Board of Elections Gary Boone, Nicholson can appeal to the State Board of Elections. It is not known as to whether he will do so.
