
A months-long dispute over an unpermitted mine along the Nolichucky River in Mitchell County is still unfolding. Drone footage taken Friday, August 1st, appears to show ongoing activity near the Poplar Boat Launch off Hwy 197 despite state warnings.
The mine, reportedly operated by Horizon 30, LLC, has been under scrutiny since early 2025. The North Carolina Department of Environmental Quality (NCDEQ) says the company has continued operations without securing a proper mining permit, despite repeated notices and inspections.
A partial application was submitted in April, but it remains incomplete. NCDEQ issued multiple violations and a Notice of Continuing Violation in June. The department is still awaiting required documentation.
In a letter, Horizon 30 claims the mine is supplying materials for emergency CSX railroad repairs caused by Tropical Storm Helene and cites federal emergency orders as justification. However, state officials say those claims don’t excuse the lack of a permit. Neither Horizon 30 nor CSX, has responded to media inquiries.
At a Mitchell County Commissioners meeting Monday evening, residents reported late-night explosions, animal deaths, and displaced wildlife. Commissioners acknowledged concerns and committed to passing public comments to state regulators.
The NC Department of Justice has filed a legal complaint seeking to halt operations until proper permits are secured. A court hearing is scheduled for Monday, Aug. 11, in Boone.
